General conditions
These regulations define the terms of use of the Advertising Agency's services DORA GRAPHICS (reg no. 631958) hereinafter referred to as the regulations ,,Dora Graphics".
Using the services of the Dora Graphics means full acceptance of this regulations and rules contained therein.
Dora Graphics reserves the right to make changes to this Site and to these Terms of Usage at any time without prior notice. You should review these Terms of Usage each time you access this Site or place a print order.
In matters not regulated by these regulations, they shall apply provisions of the Civil Code, the Act on the Protection of Personal Data and the Law on copyright and related rights.
Order
The order placed by the Customer must be in the form of a signed order form or an e-mail expressing the will to order the service.
The service can be ordered online via the online store at www.dora-graphics.com or via Facebook page or Whatsapp only in written form.
The customer is obliged to provide their data to the Dora Graphics enabling the correct invoice issue.
The Dora Graphics undertakes not to share Customers` contact details to third parties, but use them as intended the Act on the Protection of Personal Data.
Graphic design
At the time of proposal, Dora Graphics will provide the customer with a written estimate or quotation by email, Facebook page messenger, Facebook private messenger or Whatsapp.
These Terms and Conditions can be read at any time on the Dora Graphics website.
The client may send an official purchase order in reply to the estimate or quotation which binds the client to accept our terms and conditions, or an email or any other electronic way acknowledging acceptance of the quotation.
For the avoidance of doubt, the Dora Graphics Terms & Conditions are what govern the job, not any conditions on the customer’s purchase order.
Design charges
Direct proposal
Charges for design services provided by Dora Graphics will be set out in a written estimate or quote provided to the client. Once the customer has signed the acceptance of this quote or quote indicating acceptance of the Terms, a non-refundable payment of 50% of the quoted fee will become immediately due for website design or logo design orders only.
Unless otherwise agreed with the Client, all design services require payment of 100 percent of the project valuation prior to commencement of work. The remaining fifty (50) percent of the total design valuation amount for Web design and logo design will be payable upon completion of the work prior to uploading or making the materials available.
Online shop purchase
Online purchases of any digital graphic project except Logo graphic design are charged fully.
In case of customer dissatisfaction with the project the purchase is refunded in only 50% of the fee.
Source Files
We will supply proofs and PDF files as appropriate for printing, or other graphic files as detailed in the job scope or request.
Charges for design work do not cover the release of our copyright design source files, including but not restricted to indd, psd, AI, svg, fla or other source files or raw code; if the Client requires these files for transfer to an in-house or other designer, they will be subject to a separate quotation or ‘buy-out’ charge.
Charges for Other Services
Charges for any additional services requested during the project that are over and above the estimated time or out of scope, will become fully payable (100% of the quoted amount) at the time of estimate or quotation acceptance.
Default
An account shall be considered default if it remains unpaid for 7 days from the date of invoice. Dora Graphics shall be entitled to remove Dora Graphics‘s and/or the customer’s material from any and all computer systems, until the amount due has been fully paid. This includes any and all unpaid monies due for services, including, but not limited to, design and maintenance, sub-contractors, printers, photographers and libraries.
Removal of such materials does not relieve the customer of its obligation to pay the due amount.
Customers whose accounts become default agree to pay all Dora Graphics ‘s reasonable legal and accounting expenses and third party collection agency fees in the enforcement of the debt and these Terms and Conditions.
Copyrights and Trademarks
By supplying text, images and other data to Dora Graphics for inclusion in the customer’s website or other medium, the customer declares that it holds the appropriate copyright and/or trademark permissions. The ownership of such materials will remain with the customer, or rightful copyright or trademark owner.
Any artwork, images, or text supplied and/or designed by Dora Graphics on behalf of the customer, will remain the property of Dora Graphics and/or its suppliers unless otherwise agreed in writing. A licence for use of the copyright material is granted to the customer solely for the project defined in the scope or request and not for any other purpose.
The customer may request in writing from Dora Graphics, the necessary permission to use materials (for which Dora Graphics holds the copyright) in forms other than for which it was originally supplied, and Dora Graphics may, at its discretion, grant this and may charge for the additional usage. Such permission must be obtained in writing before any of the aforesaid artwork, images, text, or other data is used.
Any software, code, plugin or other third party material used in a web or digital project remains the property of the creator and any ongoing licence fees or fees for upgrades are the responsibility of the client, not Dora Graphics.
By supplying images, text, or any other data to Dora Graphics, the customer grants Dora Graphics permission to use this material freely in the pursuit of the design.
Should Dora Graphics, or the customer supply an image, text, audio clip or any other file for use in a website, multimedia presentation, print item, exhibition, advertisement or any other medium believing it to be copyright and royalty free, which subsequently emerges to have such copyright or royalty usage limitations, the customer will agree to allow Dora Graphics to remove and/or replace the file on the site.
The customer agrees to fully indemnify and hold Dora Graphics free from harm in any and all claims resulting from the customer in not having obtained all the required copyright, and/or any other necessary permissions.
Changes
The customer agrees that changes required over and above the estimated work, or in addition to the agreed scope, or where the client makes changes to the supplied copy or changes required to be carried out after acceptance of the draft design, will be liable to a separate charge.
The customer also agrees that Dora Graphics holds no responsibility for any amendments made by any third party, before or after a design is published.
Licensing
Any design, copywriting, drawing, idea or code created for the customer by Dora Graphics, or any of its contractors, is licensed for use by the client on a one-time only basis and may not be modified, re-used, or re-distributed in any way or form without the express written consent of Dora Graphics and any of its relevant sub-contractors.
All design work – where there is a risk that another party make a claim, should be registered by the client with the appropriate authorities prior to publishing or first use or searches and legal advice sought as to its use.
Dora Graphics will not be held responsible for any and all damages resulting from such claims.
Dora Graphics is not responsible for any loss, or consequential loss, non-delivery of products or services, of whatever cause. The customer agrees not to hold Dora Graphics responsible for any such loss or damage.
Any claim against Dora Graphics shall be limited to the relevant fee(s) paid by the customer.
Data Formats
The client agrees to Dora Graphics’s definition of acceptable means of supplying data to the company.
Text is to be supplied to Dora Graphics in electronic format as standard text (.txt), MS Word (.docx) or via e-mail / FTP or shared folder.
Dora Graphics is not responsible for errors detected after acceptance project by the client.
Dora Graphics is not responsible for errors in the project sent by a client.
Images which are supplied in an electronic format are to be provided in a format as prescribed by Dora Graphics via e-mail / FTP. Images must be of a quality suitable for use without any subsequent image processing, and Dora Graphics will not be held responsible for any image quality which the client later deems to be unacceptable.
Dora Graphics cannot be held responsible for the quality of any images which the client wishes to be scanned from printed materials.
Additional expenses may be incurred for any necessary action, including, but not limited to, photography and art direction, photography searches, media conversion, digital image processing, or data entry services, colour correction and alteration of images
Design Project Duration
Any indication given by Dora Graphics of a design project’s duration is to be considered by the customer to be an estimation. Dora Graphics cannot be held responsible for any project over-runs, whatever the cause. Estimated project duration should be deemed to be from the date that cleared funds are received by Dora Graphics for the initial payment or by date confirmed in writing by Dora Graphics.
Design Project Completion
Dora Graphics considers the design project complete upon receipt of the customer’s signed Approval form or signoff email. Other services such as printing, display panel production, filmwork, website uploading, publishing etc either contracted on the client’s behalf constitute a separate project and can be treated as a separate charge.
Website design
-Before starting the design of the website, the customer is required to pay a 50% non-refundable deposit.
-The customer should provide all necessary materials such as texts, photos, logo if they have it, contact information etc. in relevant files and of good quality.
-Dora Graphics is not responsible for web hosting and positioning (SEO).
-Dora Graphics is not responsible for content and materials provided by the customer needed to create the page.
-The customer is obliged to pay the rest of the amount due after completing the design of the site but BEFORE connecting the domain.
-Dora Graphics does not moderate the websites after completing the order, however, Dora Graphics can do it at the customer's request for an extra cost
-After finish the website, the client receives simple instructions for using the website if requested
Dora Graphics require that a template is approved by the customer before coding/designing of a site commences. Once the template(s) for the web site are approved by the customer, coding/designing will commence; any changes to navigation items, colours, structure or content that require changes to the template will incur an additional charge.
Once web design is complete, Dora Graphics will provide the customer with the opportunity to review the resulting work. Dora Graphics will make one set of minor changes at no extra cost within 14 days of the start of the review period. Minor changes include small textual changes and small adjustments to placement of items on the page. It does not include changes to images, colour schemes or any navigation features. Any minor changes can be notified to Dora Graphics by e-mail.
Dora Graphics will consider that the client has accepted the original draft, if no notification of changes is received in writing from the customer, within 14 days of the start of the review period.
Rights of Access for Website Construction
The client agrees to allow Dora Graphics all necessary access to computer systems and other locations, as required, in order to complete a website project and until all due funds are cleared, including the necessary read/write permissions, usernames and passwords.
The customer also agrees to allow Dora Graphics access to any computer systems, usernames and passwords required to remove data and/or sites for failure to comply with these Terms and Conditions.
The customer agrees to supply Dora Graphics with all necessary materials, electronic, or otherwise, required to create and complete the project, and to supply them in a timely manner.
Website hosting
Dora Graphics does not offer hosting services. The customer is obliged to pay for hosting services of an external virtual server indicated by Dora Graphics. Dora Graphics does not guarantee service continuity and is not responsible for any loss of service, regardless of the cause.
Dora Graphics may request that customers change the type of hosting account they are using if that account is found by Dora Graphics to be inadmissible due to poor service quality, lack of bandwidth, or otherwise insufficient to support the website.
Fees payable to third party hosting organizations are the responsibility of the customer and Dora Graphics is not responsible for their payment or for domain name renewal for which the customer / domain owner is solely responsible.
Domain registration
Dora Graphics does not register and does not guarantee the availability of any domain name. The purchase and registration of the domain and the provision of the domain to Dora Graphics for the complete creation of the website is the responsibility of the customer
Search Engine Submission (SEO)
Dora Graphics doesn`t provide SEO services.
Due to the infinite number of considerations that search engines use when determining a site’s ranking, Dora Graphics cannot guarantee any particular placement. Acceptance by any search engine cannot be guaranteed and when a site is accepted, the time it takes to appear in search results varies from one search engine to another. Rankings will also vary as new sites are added. Dora Graphics recommend that customers use a professional SEO company and are happy to provide details of such companies, but accept no responsibility for their services.
Design Credits
The customer agrees to allow Dora Graphics to place a small credit on printed material exhibition displays, advertisements and/or a link to Dora Graphics own website on the customer’s website. This will usually be in the form of a small logo or line of text placed towards the bottom of the page.
The customer also agrees to allow Dora Graphics to place websites and other designs, along with a link to the client’s site on Dora Graphics’s own website for demonstration purposes and to use any designs in its own publicity and portfolios.
Rights of Refusal
Dora Graphics will not include in its designs, any text, images or other data which it deems to be immoral, offensive, obscene or illegal. All advertising material must conform to all standards laid down by all relevant advertising standards authorities. Dora Graphics also reserves the right to refuse to include submitted material without giving reason. In the situation where any images and/or data that Dora Graphics does include in all good faith, and subsequently discovers is in contravention to such Terms and Conditions, the customer is obliged to allow Dora Graphics to remove the contravention without hindrance, or penalty. Dora Graphics is to be held in no way responsible for any such data being included.
Printing
Print charges
Direct proposal
Charges for printing services to be provided by Dora Graphics will be set out in the written estimate or quotation that is provided to the customer. At the time of the customer’s signed acceptance of this estimate or quotation, indicating acceptance of the Terms & Conditions, payment of 100% of the quoted fee will become immediately due.
Online shop purchase
Online purchases of any printing services are charged fully.
Order Deadlines
Print ready artwork must be supplied by the order deadlines quoted on our website. Our production deadlines and turnarounds only start once artwork has been correctly supplied or signed off.
Product Colours
The print result is dependent on many factors, including the character of the paper from individual manufacturers, e.g. the degree of whiteness, the grain direction and/or whether the product is gloss/matt/silk, the print site’s climate conditions, such as temperature or air humidity. Should colour deviations within the tolerance range arise for reasons of this sort, then due to the way our system works the fullest use to capacity of our forms and machines this will not constitute a reason for complaint. Colour deviations also may happen for product using i.e. UV, Spot UV, any kind of lamination, sealer or media. The CMYK colour model, referred to as process colour or four colour, is a subtractive colour model, used in colour printing, also used to describe the printing process itself. CMYK refers to the four inks used in most colour printing: cyan, magenta, yellow, and key black. Though it varies by print house, press operator, press manufacturer and press run, ink is typically applied in the order of the abbreviation. We cannot give guarantee of colour matching to your product (include re-print) at all.
Please be aware that a colour on your screen or on your printout from an ink-jet printer will look slightly different to the finished print product. A computer screen shows colours using the RGB System; an offset printer uses CMYK.
Customer ready files
Customer is obliged to upload their printing file by form submitted after the online purchase or to send their printing file to the email provided by Dora Graphics.
Dora Graphics doesn`t take any responsibility for customer`s printing files, errors, wrong dimensions, etc. Dora Graphics provide list of instructions for every print linked here. However client can request for checking their printing files for extra costs.
Customers`s printing file shall be uploaded only in pdf file. No other file formats will be accepted.
Dora Graphics reserves the right not to print customer materials if they contain illegal content.
Personalised clothing and gadgets
Textiles and mugs Online & Offline ordering – products, sizes, colours
Please note, Dora Graphics order blank clothing, garments and products from wholesaler distributors, and then customise these items with printing for our clients. All sizes and colours shown online on the catalogues and online shop are not under our control, and we cannot be held accountable for colour variations from on screen colours to real product colours, nor can we be held responsible for sizing issues. We do our very best with our Quality Controls to manage these rare problems.
Please also note that, if a specific colour or size is not available, with orders, if we have not got the time to contact you, we may swap the garment or product for an alternative in a similar colour and style and size, in order to fulfil your order. All Online Orders will be processed with either DTG, Screen Printing, Transfer or Vinyl Printing, whatever is deemed suitable for your order by our print team. By accepting our terms and conditions, you understand, agree and accept any change we make in the fulfilment of your order, with no rights of refund.
Sizes
Under each product, the dimensions of clothes for children, women and men are given, depending on the type of product. Dora Graphics does not take responsibility for the wrong size choosen by the customer. Such product cannot be returned or exchanged.
Artwork supplied by client
We will print the artwork you supply us. When uploaded or emailing us any artwork you give Dora Graphics, full consent to print the artwork or designs. You confirm that the artwork is yours to use, and/or free from copyright infringement. You accept full responsibility in the event of any copyright infringement, and will fully indemnify Dora Graphics. When emailing us or uploading artwork and upon payment you accept this artwork disclaimer in full.
The online visual template and visual designer are not scaled. The size of the printed artwork may vary depending on the representation and aspect ratio you see online.
We will always aim to print your exact print sizes but you accept there may be up to a 2cm variance on print sizes and positioning.
You accept full responsibility and confirm you have either provided print ready files, discussed this with us prior to payment, or are happy to pay a small charge, and also confirm that we will not be held responsible for sub-quality print finishes that are caused as a result of sub-quality and non-print ready artwork files. If you have any doubt please get in touch and we will check.
For online sales, all artworks/files uploaded will be printed without artwork checking, and any quality issue will not be the responsibility of us. You will not be entitled to a refund or reprint if the artwork you provided us does not meet our minimum artwork guidelines requirements.
Returns
Due to the nature of the product, no returns can be made once the order is processed and/or shipped. Any claims for defects, damages, or shortages must be made in writing within two (2) business days after receipt of the merchandise. We will replace only those orders that were processed incorrectly. The replacement of the order will take place only after the receipt of returned merchandise. We will not replace the order if it is determined by us that the order was misused or mishandle by the buyer or part of the order was used by the buyer and part of the order is being returned.
Dora Graphics reserves that each printout may have slightly different colors from the submitted project or visualization, which is not covered by the complaint.
Dora Graphics does not guarantee the repeatability of the color in the next expenditures printouts of any advertising materials.
The colors displayed on the monitor may differ from the actual colours - this is due to the specificity of displaying images on the monitor.
In the case of cuts and prints made on many types of film and paper and other materials used during the contract is the responsibility of the manufacturer of the aforementioned materials, and the Dora Graphics is not responsible. The customer is required to comply with the rules of use of the above-mentioned materials in accordance with the instructions received from the Dora Graphics in writing or verbal.
Dora Graphics is not responsible for mechanical damage, the influence of weather conditions, operation and inadequate maintenance of materials and products purchased by the customer
Cancellation
The order can be canceled only if it is in the basket. To do this, click the "remove product" icon. If your order has already been paid, you can cancel it within one hour of purchase by contacting us by email or phone.
Remember - orders sent for production cannot be cancelled!
Shipping
The goods are sent to the address indicated in the order form or given by phone or by email.
The goods are delivered by courier companies or via Anpost. In some cases, there is a possibility of personal collection of goods at the seller's premises.
Dora Graphics provide deadlines for each product. However, Dora Graphics reserves the right to extend the shipping time for technical and other reasons
The shipping fee depends on the quantity and size of the products sent.
The advertising agency is not liable for damage or loss of a shipment in transit.
A customer choosing Standard Post will not receive a tracking number for their shipment.
Deliveries during busy periods of adverse weather conditions
At periods of seasonal high demand, or during adverse weather conditions, delivery deadlines may be missed or delayed. We will organise and ship your goods in accordance with your delivery deadline. The items will be despatched using a 3rd party courier and we will be able to provide documentary evidence for this. If the delivery is not achieved for whatever 3rd party reason, Dora Graphics will not be responsible for refund of any form. We will attempt to recover costs and expenses from our 3rd party delivery companies, but cannot guarantee any delivery or refund in these instances.
Dora Graphics will not be liable for any loss or expenses sustained arising from any delay or failure in the delivery of the goods
Payments
Payments may be made by bank or online transfer, credit card (Visa, Mastercard) or Debit Card.
Dora Graphics doesn`t take payment by checks.
Publication and/or release of work done by Dora Graphics on behalf of the client, may not take place before cleared funds have been received.
